Will I Get More Settlement Money with a Personal Injury Lawyer?

Short answer: In many serious injury cases, the right lawyer can help a client recover more money, even after attorney fees and case expenses. But no lawyer can promise a higher settlement. The real question is whether a lawyer can improve your net recovery – the amount you receive after fees, expenses, medical bills, and liens are paid.

At Baumgartner Law Firm, we look at three things before discussing claim value: who is responsible, how the injury changed the person’s life, and what insurance or other resources are available to pay the claim. A strong case needs all three. If you want a case-specific evaluation, speak with a Houston personal injury lawyer.

A Larger Settlement Is Not the Same as a Larger Net Recovery

Settlement advertisements often focus on the gross amount. That number matters, but it does not tell you what the injured person takes home. A fair comparison should consider every deduction.

Term

What it means

Gross settlement

The total amount paid by the insurer or defendant.

Attorney fee

The agreed percentage paid under the contingency-fee contract.

Case expenses

Costs such as records, filing fees, depositions, and experts.

Medical bills and liens

Amounts that may have to be paid or negotiated from the recovery.

Net recovery

The amount the client receives after authorized deductions.

A Simple Example

Suppose an insurer offers $30,000 before a lawyer is hired. A lawyer later develops evidence supporting a $60,000 settlement. The $60,000 figure is not automatically the better result. You still must subtract the attorney fee, case expenses, and medical obligations from each option. This is only an illustration, not a prediction of any case.

A lawyer may also add value by negotiating medical bills or liens. That work can affect the client’s final check even when the gross settlement receives most of the attention.

What Does the Research Show?

Older insurance-industry research is often cited for the view that represented auto-injury claimants receive larger recoveries on average. The Insurance Research Council has also reported substantial attorney involvement in bodily-injury claims. But an average is not a promise, and it does not prove that hiring a lawyer caused every difference. Serious claims are also more likely to involve attorneys.

For that reason, we do not tell an injured person that hiring any lawyer will automatically multiply a settlement. The lawyer, the facts, the available insurance, and the quality of the proof all matter.

How the Right Lawyer May Increase an Injury Claim’s Value

1. Find every responsible party and insurance policy

The first offer may be based on only one driver or one policy. A careful investigation may identify an employer, property owner, product manufacturer, alcohol provider, contractor, or another company that shares responsibility.

This is especially important in a commercial truck accident claim, where the driver, motor carrier, broker, maintenance company, cargo loader, or equipment owner may need to be investigated. More defendants do not always mean more compensation, but missing a responsible party can limit the recovery.

2. Preserve evidence before it disappears

Video can be erased. Vehicles can be repaired or destroyed. Witnesses move, and memories fade. In commercial cases, electronic data and company records may be lost under routine retention policies. Early preservation letters, inspections, records requests, and witness interviews can change what can later be proved.

3. Prove the full medical picture

Current medical bills are only part of a serious injury claim. The evidence may also need to address future surgery, therapy, medication, home care, disability, disfigurement, and the effect of the injury on daily life. A lawyer cannot create damages that do not exist. The job is to make sure real losses are not overlooked or poorly documented.

4. Document lost income and reduced earning capacity

A paycheck shows time already missed. It may not show the long-term effect of an injury on promotions, overtime, physical work, a business, or the ability to remain in the same career. Tax records, employment files, vocational evidence, and expert analysis may be needed when the future loss is significant.

5. Challenge unfair blame

Insurers sometimes argue that an injured person caused or worsened the accident. Under Texas’s proportionate-responsibility law, a claimant who is more than 50% responsible generally cannot recover damages, and a claimant who is 50% or less responsible may have the award reduced by that percentage. Evidence that answers an unfair blame argument can protect substantial value.

6. Build credible litigation and trial risk

An insurer evaluates risk. A demand has more weight when the evidence is organized, the damages are supported, deadlines are protected, and the lawyer is prepared to file suit and try the case if necessary. A loud demand letter is not a substitute for preparation.

7. Review the settlement terms and medical obligations

The settlement amount is only one part of the agreement. Releases can be broad, and medical providers, health plans, Medicare, Medicaid, or other parties may claim a right to repayment. Handling those issues can affect both the safety of the settlement and the client’s net recovery.

What Greg Baumgartner Has Learned Since 1985

Greg’s perspective: The largest increases in case value rarely come from using stronger adjectives in a demand letter. They usually come from finding something important that was missed – another policy, a corporate safety failure, a witness, electronic data, a future medical need, or proof of lost earning ability.

At Baumgartner Law Firm, we keep a selective caseload because serious cases require time. We investigate early, learn how the injury affected the client and family, and prepare the claim as though disputed issues may have to be proved. That approach has helped us obtain significant results in serious injury and wrongful death cases, but past results never guarantee a future outcome.

You can review representative personal injury case results and the required result disclaimers on our website.

When Is a Lawyer Most Likely to Add Value?

Legal representation is generally more important when:

  • the injuries are serious, permanent, or require future care;
  • fault is disputed or several parties may share responsibility;
  • a commercial vehicle, company, or government entity may be involved;
  • the insurer asks for a recorded statement or broad medical authorization;
  • the available insurance policies are unclear;
  • the claim includes lost earning capacity, disability, or a substantial lien;
  • the insurer denies the claim or makes an early low offer; or
  • a lawsuit may be needed to obtain evidence or fair consideration.

When Might Hiring a Lawyer Not Improve the Net Result?

Not every claim needs full legal representation. A lawyer may add limited economic value when there is only property damage, the injury is minor and resolved, the insurer has already offered the full available policy limit, or there is no insurance or collectible defendant. Liability and causation problems can also make a claim difficult regardless of representation.

An honest consultation should address those limits. Sometimes the most useful advice is that a person may be able to handle a small claim without giving up part of the recovery.

Attorney Fees, Expenses, and Questions to Ask

Most Texas injury firms use a contingency-fee agreement. That usually means the lawyer receives an agreed percentage only if money is recovered. The percentage, litigation increase, case expenses, and responsibility for expenses should be stated in writing. Learn more about how Texas personal injury attorneys get paid and review our explanation of contingency fees in Houston injury cases.

Before signing, ask:

  • What percentage applies before and after a lawsuit is filed?
  • Are case expenses deducted before or after the attorney fee is calculated?
  • Who is responsible for expenses if no money is recovered?
  • Who will handle my case and communicate with me?
  • Does the lawyer regularly handle my type of accident and injury?
  • How will medical bills and liens be addressed?

Do Not Wait Too Long to Get Advice

In many Texas personal injury cases, Texas Civil Practice and Remedies Code section 16.003 provides a two-year filing deadline. Different deadlines and exceptions can apply, including claims involving governmental defendants and minors. Evidence can disappear long before the filing deadline, so prompt advice may matter even when settlement talks are underway.

Frequently Asked Questions

Do personal injury lawyers get higher settlements?

Represented claimants often recover more on average, but no lawyer can guarantee a higher settlement. The result depends on liability, injuries, insurance, evidence, and the lawyer’s work.

Will I receive more after paying the lawyer’s fee?

You may receive a larger net recovery if the lawyer adds more value than the fee and expenses. The correct comparison includes medical bills, liens, costs, and every other deduction.

How much do personal injury lawyers charge in Texas?

Many Texas personal injury lawyers use contingency fees, but percentages and expense terms vary. Read the written agreement and ask how the fee is calculated before signing.

Can I negotiate an injury settlement myself?

Yes. But serious claims can involve evidence, medical proof, comparative fault, liens, deadlines, and release language that may be difficult to handle without legal advice.

Does hiring a lawyer guarantee a settlement?

No. An ethical lawyer cannot guarantee a settlement amount or even that a recovery will occur.

Should I accept the insurance company’s first offer?

Do not accept an offer until you understand your injuries, future medical needs, available coverage, and all deductions. Signing a release usually ends the claim.
