Uber’s Commercial Policy

 

According to their website, Uber maintains a commercial policy issued by James River Insurance Company through its wholly-owned subsidiary Rasier, that contracts directly with the Uber drivers.

 

The commercial policy covers liability situations when a “Named Operator” (the ride-sharing driver) has accepted a ride and is in route to pick up their passengers or are transporting passengers at the time of the crash.

 

This commercial policy provides coverage up to $1 million per incident for bodily injury or property damage to passengers or third parties involved in a crash with the Uber driver. This policy, according to Uber also provides $1 million of uninsured/underinsured motorist coverage to protect their passengers.

 

The Uber policy will apply whenever the driver has accepted a trip, up to its conclusion and will be the primary liability insurance coverage for the Uber driver in the event of an accident unless the Uber driver has other commercial coverage.

 

Uber Between Rides Contingent Coverage

 

Uber also has a contingency policy for situations between rides where the driver is waiting for a ride, but does not have personal coverage that applies. However, the between ride coverage provides much less liability coverage than the commercial policy. The liability limits for the between rides Uber policy are limited to $50,000 per person/$100,000 per accident with an additional up to $25,000 for property damage.

 

The Drivers Personal Policy

 

If the Uber driver has not accepted a ride at the time of the crash, their personal automobile policy will provide liability coverage for accidents caused by the Uber driver. If the driver’s policy has lapsed, the between rides contingent policy set forth above probably will kick in.

 

For people injured while writing with the Uber driver, the commercial policy will provide protection for the negligence of the Uber driver and also for situations where the accident is the other driver’s fault, and the driver has no insurance or inadequate insurance coverage.
