A polished tour and a written safety policy are helpful, but daily practice matters more. Watch how teachers position themselves, whether doors and gates are secured, and whether staff appear focused on the children rather than phones, paperwork, or unrelated duties.

What Proper Daycare Supervision Looks Like

The Texas Minimum Standards for Child-Care Centers require a caregiver to know which children are assigned to the caregiver, how many children are in the group, and each child’s name and age. The caregiver must remain close enough and visually or audibly aware enough to protect each child and intervene when necessary.

The level of supervision should fit the child and the setting. A toddler near climbing equipment or water needs closer attention than a school-age child seated at a table. Room layout, known hazards, a child’s development and the activity underway all matter. Meeting a numerical staff-to-child ratio does not, by itself, answer whether the supervision was adequate at the moment an injury occurred.

Save a copy of the records you review because online information can change over time.

What Parents Should Do After a Daycare Injury

Get appropriate medical care first. Once the child is safe, preserve the information needed to understand what happened before memories fade, records are overwritten or the scene changes.

  1. Ask the director and the caregivers to explain what happened, when it happened and who was present. Write down the answers, including any differences between the accounts.
  2. Request a copy of the daycare’s written incident report. Do not sign an account that is incomplete or inaccurate merely to obtain a copy.
  3. Photograph the injury and, when possible, the location, equipment or condition involved. Keep damaged clothing or other physical evidence.
  4. Save emails, text messages, daycare-app messages, photographs, medical records, bills and the names of possible witnesses.
  5. Promptly ask the center in writing to preserve relevant video, photographs, attendance records, classroom rosters, staff schedules and incident documents. Many surveillance systems overwrite recordings automatically.
  6. Review the center’s state inspection history and save the records that may relate to the incident.

Not every daycare injury results from negligence. The key question is whether the center used reasonable care under the circumstances and followed the safety rules that applied.
