Fault depends on the facts. In Texas, intersection cases frequently involve right-of-way rules, signal lights, stop signs, safe turning duties, and each driver’s speed and attention. Texas Transportation Code Section 545.151 addresses vehicles approaching or entering an intersection. Texas Transportation Code Section 545.152 addresses left turns and requires a driver turning left to yield to oncoming traffic that is close enough to be a hazard.
That does not mean the left-turning driver is always at fault. A speeding driver, distracted driver, drunk driver, or driver who ran a red light can also be responsible.
