Greg Baumgartner, founder of Baumgartner Law Firm, has spent 40 years representing accident victims in Houston and across Texas. He holds a perfect 10.0 AVVO rating, dual law degrees (placing him in the top 1% of Houston attorneys), and is a graduate of the Trial Lawyers College. He has been recognized as a preeminent personal injury attorney for decades and named to the Top 100 Trial Lawyers and Super Lawyers lists.
Our legal team has built a specific track record in rideshare accident litigation — navigating the insurance tiers, securing critical app data, and going up against Lyft’s commercial carriers when they undervalue claims. You will work directly with an experienced attorney on your case, not a paralegal or junior associate.
We recently settled a Houston Lyft accident case for over 6× the compensation another firm received for the same incident and comparable injuries. The difference came down to case preparation and refusing a low early offer.

Lyft accident claims are fundamentally different from ordinary car accident cases. The combination of commercial insurance policies, independent contractor status disputes, app data preservation, and multi-party liability requires an attorney with specific rideshare experience. Here’s what to look for:
Your attorney must understand Lyft’s tiered insurance structure and how to challenge coverage disputes between personal and commercial carriers.
Insurers offer higher settlements to firms they know will take cases to trial. Look for an attorney with actual courtroom experience in serious injury cases.
Check ratings on sites like Martindale.com, where rankings are based on peer attorney reviews — not paid placements. AVVO scores are also peer-informed.
Ask who will actually handle your case day to day. High-volume firms often assign new associates or paralegals. At Baumgartner Law Firm, you work directly with an experienced attorney.
Genuine reviews from former clients are more valuable than volume. Look for reviews that describe specific outcomes, communication quality, and personal attention.
Your attorney will represent you for months or years. Meet in person before signing. Changing attorneys mid-case is possible but disruptive — choose carefully upfront.
The steps you take in the hours and days after a Lyft crash can significantly affect your ability to recover full compensation. Here’s what our Houston rideshare accident attorneys recommend:
One of the most confusing aspects of a Houston Lyft accident claim is determining which insurance policy applies. Coverage depends entirely on what the Lyft driver was doing in the app at the exact moment of the crash. There are three distinct coverage phases, each with very different limits.
Driver’s Personal Auto Insurance Only
If the Lyft driver had the app closed at the time of the crash, Lyft provides zero coverage. The accident is treated exactly like any other collision — only the at-fault driver’s personal auto policy applies. If that driver is uninsured or underinsured, your own UM/UIM policy may be your only recourse.
Lyft coverage: $0Personal policy only
Texas minimum: $30,000 per person/$60,000 per accident for bodily injury.
Lyft Contingent Liability Coverage
Once the driver logs into the Lyft app and is available for rides — but has not yet accepted a specific request — Lyft’s contingent liability coverage activates. This only applies if the driver’s personal policy does not cover the loss. Coverage is limited and may not be enough for serious injuries.
$50,000 per person$100,000 per accident$25,000 property damage
This is contingent coverage — Lyft’s policy only pays if the driver’s own insurer denies the claim or is insufficient.
Lyft’s $1 Million Commercial Policy
From the moment the driver accepts a ride request through the completion of the trip, Lyft’s primary commercial insurance policy is active. This is the highest protection tier and covers passengers, other motorists, pedestrians, and cyclists injured by the Lyft driver’s negligence.
$1,000,000 liability
Why this matters for your claim: Insurance adjusters from both the driver’s personal insurer and Lyft’s commercial carrier will often dispute which phase was active at the time of the crash — and therefore which policy owes you compensation. These coverage disputes are one of the most common reasons Lyft accident claims are delayed or underpaid. An experienced Houston rideshare accident attorney can obtain the driver’s app data to establish exactly which phase applied.
Which Insurance Applies to Your Situation?
Your Role in the Accident | Primary Coverage Source | Potential Backup Coverage |
Passenger in the Lyft (Phase 3) | Lyft’s $1M commercial policy | Your personal auto policy (MedPay / PIP) |
Driver struck by a Lyft vehicle (Phase 3) | Lyft’s $1M commercial policy | Your UM/UIM coverage if limits are exceeded |
Passenger — other driver caused the crash | At-fault driver’s liability policy | Your own UM/UIM |
Pedestrian or cyclist hit by Lyft driver | Lyft’s $1M policy (if Phase 3) | Driver’s personal policy (Phases 1–2) |
Struck by Lyft driver (app on, no ride — Phase 2) | Driver’s personal policy first | Lyft contingent: $50K/person, $100K/accident |
As an injured passenger, you are generally not liable for the accident. The at-fault driver’s liability insurance is the primary source of coverage. If that driver has insufficient coverage or is uninsured, your own UM/UIM may provide additional compensation. Our attorneys will identify every applicable policy and pursue all available coverage simultaneously.
If your Lyft driver was at fault, Lyft’s $1 million commercial policy (Phase 3) applies from the moment the ride was accepted. This covers your medical expenses, lost income, pain and suffering, and other damages. These claims are often contested by Lyft’s insurer, making experienced legal representation essential.
If a Lyft driver struck you while you were in your own car, coverage depends on the driver’s app status. In Phase 3, Lyft’s $1M policy is your primary source. In Phase 2, Lyft’s contingent coverage applies after the driver’s personal policy. In Phase 1, only the driver’s personal insurance is available. Disputes between insurers are common in these cases.
Pedestrians and cyclists struck by Lyft drivers have the same rights to compensation as any other accident victim. Texas law imposes a duty of care on all drivers — rideshare drivers are no exception. Lyft’s commercial policy or the driver’s personal policy will apply, depending on app status at the time of the collision.
Under Texas law, the spouse, children, and parents of a person killed in a Lyft accident may bring a wrongful death claim. If the victim survived for a period before passing, the estate may also file a survival action to recover damages incurred before death, including medical expenses, pain and suffering, and funeral costs. Always consult an attorney immediately after a fatal rideshare crash — the statute of limitations begins at the date of death.
Texas personal injury law allows Lyft accident victims to seek compensation for the full range of economic and non-economic losses resulting from the crash. In cases involving gross negligence, punitive damages may also be available.
Current and future — ER visits, surgery, hospitalization, physical therapy, prescription medications, and specialist care.
Income is lost during recovery, and there is a reduced future earning ability if injuries result in lasting disability.
Physical pain, emotional distress, anxiety, and psychological trauma were caused by the accident and injuries.
Compensation for permanent scarring, loss of limb or function, and long-term physical impairment.
Repair or replacement of your vehicle and any personal property damaged in the crash.
Compensation for activities, hobbies, and quality of life diminished by your injuries.
Documented psychological harm, including PTSD, depression, and anxiety, stemming from the collision.
Loss of companionship, loss of financial support, grief, and survival action damages for fatal rideshare accidents.

If you or a loved one suffered a Lyft Accident, you are sure to have questions and concerns. The best way to answer your questions is to call us for a free consultation. Here are a few questions that our experienced Houston Lyft Accident attorney is frequently asked.
Yes — significantly. Lyft accident cases involve multiple insurers, coverage phase disputes, and carriers incentivized to settle quickly for less. An attorney who understands rideshare insurance structures and who insurance companies know is willing to go to trial will consistently produce higher recoveries than one who is not. Our recent result of 6× another firm's settlement for the same accident illustrates this concretely.
Prioritize medical care first — even if injuries seem minor. Then document the scene with photographs, collect driver and witness contact information, report the accident through the Lyft app and to the police, and call our firm before giving any recorded statements to insurance companies. Early legal involvement allows us to secure crucial evidence including Lyft's app data records.
Texas law gives you two years from the date of the accident to file a personal injury lawsuit (Tex. Civ. Prac. & Rem. Code § 16.003). Missing this deadline will almost certainly bar your right to any compensation. We recommend consulting an attorney as soon as possible — critical evidence such as dashcam footage and rideshare app logs can be lost quickly.
We work on a contingency fee basis — you pay nothing upfront and owe no fees unless we win your case. Our contingency fee ranges from 33.33% to 40% depending on whether we need to file a lawsuit. There are no out-of-pocket costs to you during the case. We are reimbursed costs only if we win your case.
Texas law classifies Lyft drivers as independent contractors (Tex. Occ. Code § 2402.002), which generally shields Lyft the company from direct liability for driver negligence. However, Lyft's commercial insurance policies cover qualifying accidents, and in some cases — such as when Lyft negligently retained a driver with a dangerous record — direct liability against the company is possible. Our attorneys will evaluate every avenue of liability in your case.
