Texas Auto Insurance and Accidents
Written by Greg on December 9, 2012
To be liable is to be ‘legally responsible’. With regard to vehicle accidents in Texas the following information is applicable:
*People who drive in Texas are required to pay for the accidents they cause. Most drivers do this by purchasing automobile liability insurance.
*Liability insurance pays to repair or replace the other driver’s car and pays other people’s medical expenses and legal damages (up to your limits) when you are at fault in an accident.
*Liability insurance DOES NOT pay to repair or replace your car or for your injuries. For that you would need to buy other types of coverage – such as personal injury protection or medical payments, collision, and comprehensive – to cover these costs.
*The majority of drivers purchase liability insurance only so they are able to meet the state’s financial responsibility law – or the minimum amount of coverage which is $30,000 for each injured person, up to a total of $60,000 per accident, and $25,000 for property damage per accident. This basic coverage is called 30/60/25 coverage.
*Unfortunately, with the exorbitant cost of vehicles and medical care; often the minimum amounts fall short of the other driver’s costs should you be in an accident. Therefore, other drivers could sue you to collect the difference and it is advisable to consider buying more than the basic limits to protect yourself financially.
If you drive without the minimum amount of liability insurance and are caught or in an accident you face legal ramifications because, in effect, you are breaking the law and you civil liability and also fines for failure to maintain insurance.
I also recommend that you look at obtaining Underinsured or Uninsured Motorist coverage because of the rising number of uninsured drivers and to protect yourself against being in a sever accident with little insurance coverage of the negligent driver.
